- Welcome to www.jobcrystal.com (the “Website”). The Website is the property of and is operated by JobCrystal (Pty) Ltd, a South African company with registration number 2009/000610/07 and physical address Unit 202 Omnipark, 102 Edward Street, Bellville, 7530, South Africa (“Job Crystal”, “we” or “us”).
- Job Crystal takes user privacy seriously and undertakes to ensure that personal information is kept strictly confidential and is not disclosed to third parties without your permission, subject to the terms of this Privacy Policy and applicable law.
- This privacy policy (this “Privacy Policy”) explains how we collect, use and share personal information, and it forms part of the Website Terms and Conditions of Use. By viewing or using the Website, you accept the practices described in this Privacy Policy. If you do not accept these practices, you must not register with, browse, or otherwise use the Website.
- In this Privacy Policy, as in the Terms and Conditions of Use, the term “Authorised Purpose” means the purpose for which the Website may be used, namely:
- Employers may browse the curriculum vitae of Candidates which have been published on the Website for the purpose of recruiting suitable Candidates to fill job vacancies.
- Candidates may browse job advertisements which have been published on the Website for the purpose of applying for the job vacancies so advertised.
- All activities incidental to or related to the above, and no other purposes.
- Any capitalised terms not defined in this Privacy Policy shall have the meanings given to them in the Website Terms and Conditions of Use.
- Processing of Personal Information
- In this Privacy Policy, the terms “Personal Information” and “Process” or “Processing” have the meanings given to them in the South African Protection of Personal Information Act, No. 4 of 2013 (“POPIA”). The CEO is the responsible person (as that term is defined in POPIA) in relation to the Processing of Personal Information submitted or collected via the Website.
- Personal Information of persons visiting, registering on, browsing and otherwise using the Website (collectively “Users”) is primarily Processed in South Africa. Personal Information may also be accessed remotely by authorised personnel located in the United Kingdom for operational, management and support purposes. Where this involves personal data of individuals in the United Kingdom, we will comply with applicable UK data protection laws and implement appropriate safeguards for any international transfers or remote access.
- Any User accessing or using the Website from outside South Africa acknowledges that their Personal Information will be collected and stored in South Africa and may be accessed by authorised personnel in other countries, including the United Kingdom, for the purposes described in this Privacy Policy. We will take appropriate steps to ensure that such Processing complies with applicable data protection laws and that suitable safeguards are in place.
- Personal Information is predominantly Processed by electronic means. Sometimes, to prevent fraud on the Website or for verification purposes, Personal Information may also be Processed by paper based means. Personal Information will be stored in a way that allows us to identify you for the relevant Authorised Purpose and for as long as is necessary to fulfil that purpose or comply with legal obligations.
- Please notify us of any changes to your Personal Information by sending an email to info@jobcrystal.com so that the Personal Information we hold is accurate, up to date, relevant and complete.
- Information collected from Candidates and Employers
- Candidates
For natural persons who register as users of the Website to publish their curriculum vitae on the Website and be recruited by Employers, for employment or other work related purposes (“Candidates”), the following information is collected during registration:- Full name
- Contact details (telephone number and email address)
- Username
- Password
- Race group (where provided and subject to applicable equality and employment legislation)
- Area of residence
- Current employment information
- For the entire duration of the time that each Candidate is a registered user of the Website, Job Crystal may collect further personal information from the Candidate. This includes, but is not limited to, personal preferences and other information customarily or otherwise included in a curriculum vitae or résumé, or by the particular Candidate, that may be helpful to prospective Employers in deciding whether to recruit a Candidate, or otherwise engage a Candidate in relation to employment or other work related purposes. All information of a Candidate referred to in this paragraph is referred to collectively and hereafter as “CV Information”.
- All personal information of a Candidate is used by Job Crystal to support that Candidate’s interaction with the Website, to match the Candidate to prospective Employers and other purposes incidental thereto, and for no other purpose.
- A Candidate’s email address may be used similarly but with different messages:
- Send communication regarding job offers
- Changes or updates to the Website
- Relevant news and/or information from time to time
- Contact Candidate about Job Crystal promotions and services
- Job Crystal may share a Candidate’s personal information with third parties where necessary to render services to the Candidate. Such third parties include, but are not limited to, security vendors, maintenance vendors and hosting partners.
- By registering as a user, each Candidate gives us permission to share with prospective Employers:
- The information about himself or herself referred to above
- His or her profile and CV Information
- Other information furnished by this Candidate including but not limited to, salary data, employment history, personality profile and education history
- Information taken from this Candidate’s online presence including (without limitation, his or her LinkedIn profile and / or any other social media network or site)
- Information and reports of relevance generated by Job Crystal subsidiary and / or third party verification suppliers which includes Temporary Employment Services suppliers
- Any additional information you provide to the verification suppliers in the job application or the job application process
- Profile Information, which includes the personal profile that Candidates provide, the job track from their uploaded CV, and the Candidate’s skills (which can be generated from their CV or added later)
- Your Profile Information may be used to display relevant information, such as your profile and some of the job opportunities information that are relevant to your working experience and job preferences.
- During registration, each Candidate will be required to acknowledge and agree that, in the event of a prospective Employer requesting Job Crystal to conduct credential verification checks on that Candidate, including but not limited to employment reference, consumer credit, criminal record and ID (citizen) validation checks with information sources (for example, MIE (Pty) Ltd), via MIE’s CV verification system (the Job Crystal verification supplier):
- No checks will be run unless a prospective Employer is considering the verification Candidate for employment in a particular position
- All checks will be run by the Job Crystal verification supplier
- The Candidate will give the Job Crystal verification supplier permission where the Candidate authorises the Job Crystal verification supplier to receive and process the Candidate’s personal information for the specific purpose of any verification requests, requested by potential Employer and this will be done in terms of the Job Crystal verification supplier’s privacy policy
- The Candidate agrees to authorise Job Crystal and/or the Job Crystal verification supplier to fill out forms and make enquiries about information provided by the Candidate in attest thereof
- The Candidate understands that the information mentioned above (on the Candidate’s background) as received from the Job Crystal verification supplier is for the use by the prospective employer, for the purpose of considering the Candidate’s suitability for employment and any other purpose in terms of which the Candidate’s prior consent will be obtained. The Candidate also agrees to hold the Job Crystal verification supplier harmless in the process and indemnify them against all claims which may arise as a result of them providing information as requested in terms of this agreement
- The Candidate understands that the information furnished by the Job Crystal verification supplier may include information which is negative in respect of the Candidate’s background, as detailed above. The Candidate agrees that all information relating to their background, the above (positive and negative), may be released to the persons indicated above and that such information will be evaluated objectively and confidentially by the verified members only in accordance with and for the purpose as stated above
- This information shall not be used for any other purpose
- Access to Candidate information shall be limited to only those persons employed by or contracted to Job Crystal who require access thereto to perform specific functions in relation to carrying out the Authorised Purpose (for example, full time staff or outsourced website management personnel).
- Employers
For natural or juristic persons who register as users of the Website to source and search talent for job vacancies (“Employers”), the following information is collected during registration:- Full name
- Company name and VAT number
- Company contact details (telephone number, email address and website address)
- Username
- Password
- Billing information
- Job Crystal also collects usernames, passwords and email addresses for individuals responsible for and/or authorised to use the Website on the Employer’s behalf.
- For the entire duration of the time that each Employer is a registered user of the Website, Job Crystal may collect further information from Employers.
- All information of an Employer is used by Job Crystal to support the Employer’s interaction with the Website and to match the Employer to prospective Candidates, and other purposes incidental thereto, and for no other purpose.
- By registering as a user, each Employer gives us permission to share with Candidates details of the Employer that the Employer has posted on the Website and other information furnished by the Employer for this purpose while the Employer is a registered user of the Website.
- An Employer’s email address may be used similarly but with different messages:
- Send communication regarding prospective Candidates
- Changes or updates to the Website
- Relevant news and/or information from time to time
- Contact Employer about Job Crystal promotions and services
- By registering as Users, each Employer is required to acknowledge and agree that, and provide an undertaking to Job Crystal that:
- The Employer respects the privacy of each Candidate
- The Employer will keep Candidates’ Personal Information in the strictest confidence
- The Employer will not, other than for the Authorised Purpose and/or in accordance with any agreement reached between the Employer and the Candidate concerned, sell, trade or otherwise transfer a Candidate’s Personal Information, nor the Employer’s own database compiled in respect of the Candidate, to any third party
- Access to Employers’ information shall be limited to only those persons employed by or contracted to Job Crystal who require access thereto to perform specific functions in relation to carrying out the Authorised Purpose (for example, full time staff or outsourced website management personnel).
- If an Employer requests Job Crystal to conduct any credential verification checks on prospective employees, including but not limited to employment reference, consumer credit and criminal record checks with information sources, the Employer warrant and guarantees that:
- The Employer has obtained the necessary consents from the prospective employees to process their Personal Information
- The Employer shall use any Personal Information received from Job Crystal and/or an information source solely for the purpose of assessing the prospective employees’ suitability for employment
- Candidates
- International transfers and remote access
- Personal Information collected through the Website is hosted on servers located in South Africa. Authorised personnel and service providers may access Personal Information remotely from other countries, including the United Kingdom, only for the purposes described in this Privacy Policy.
- Where Personal Information of individuals in the United Kingdom is accessed from the United Kingdom or otherwise transferred outside the United Kingdom, we will ensure that an appropriate lawful transfer mechanism is in place and that appropriate technical and organisational measures are used to protect that Personal Information.
- Cookies
- Job Crystal may use “cookies”. A cookie is a small file stored on the hard drive of your computer. “Session cookies” are used while you browse the Website, but are deleted as soon as you close your browser. “Persistent cookies” remain on your computer after the browser is closed.
- Job Crystal uses cookies to help it understand which information on the Website is most useful and effective, in order to ensure that visiting the Website is a useful experience for you.
- If you prefer, you can set your browser not to accept cookies, or to ask you each time whether you wish cookies to be accepted.
- Job Crystal may use cookies to remember your login details, so that you do not have to enter your username and password every time you log in. We do not store passwords in cookies.
- We may use analytics cookies to track and analyse usage of the Website, in order to improve our services. These cookies do not identify you personally.
- Other data
- We may collect additional information that does not, in itself, identify a specific individual. This information may include, for example, IP address, browser type, browser language, operating system, date and time of access, referring website addresses and other technical information.
- We use such information to analyse trends, administer the Website, track Users’ movements on the Website and gather broad demographic information for aggregate use.
- Disclosure by Users in public areas
- If you disclose your Personal Information in a public area, such as on your profile, CV or in a job application, that information becomes publicly available and may be collected and used by others. Job Crystal cannot be held responsible for any third party’s use of information that you make publicly available.
- You should exercise caution before disclosing any Personal Information in public areas of the Website.
- Changes to this Privacy Policy
- We reserve the right to modify this Privacy Policy at any time. Any changes will be posted on this page, and where appropriate, notified to you by email.
- Revisions will apply from the date of the publication of the revised Privacy Policy on our Website and will not have retrospective application.
- Access, correction and legal disclosures
- Upon request, we will provide a User with a description of the Personal Information that we maintain about that User, and will accommodate reasonable requests for access, correction or deletion, subject to applicable law.
- We may release account or Personal Information to third parties when we believe, in good faith, that such release is reasonably necessary to comply with law, regulation or a court order, to enforce or apply the terms of any of our User agreements, or to protect the rights, property or safety of Job Crystal, our Users or others.
